The Personal Data Protection Board (Board) published a decision (Decision) in the Official Gazette on November 1,2018 in relation to preventing advertisement notifications/calls directed to data subjects’ email addresses or cellphones (whether through SMS or calls). The Board published another decision on November 7, 2018 revising the Decision.
The Board states that data controllers and data processors who use a data subject’s personal data to direct advertisement notifications/calls to them by sending SMS or email or calling must cease processing data unless they obtain the data subject’s consent or fulfil the conditions for processing personal data under Article 5 of the Turkish Data Protection Law.
Data controllers and data processors will be jointly responsible for taking all necessary technical and administrative measures to ensure the appropriate level of security of the personal data processed pursuant to Article 12 of Data Protection Law. The Decision is available here (in
