The constitutional, justice and citizenship committee of Brazil’s lower house passed a bill amending the 1997 general telecommunications law to ban mobile operators from sending commercial messages to users, such as marketing SMS.

With the rise of instant messaging communication, telcos’ revenues from users sending SMS has plunged in recent years.

As a result, carriers began looking for other ways to maintain some sort of monetization and use of this channel, turning to commercial and marketing communications.

According to the bill, carriers that fail to comply with the prohibition, which encompasses commercial messages sent by telcos and third parties to clients, are subject to administrative sanctions and temporary suspension of services.

Unless there is an appeal against the vote, the bill will soon go the senate for debate.
